Oklahoma does offer a capital gain deduction, but it applies only to gains from real or tangible property located in Oklahoma held at least five years, or ownership interests in an Oklahoma company held at least two years, so a gain on Bitcoin does not qualify.

    Bitcoin Rights Act

    Signed by Governor Kevin Stitt, making Oklahoma the first state to enshrine a right to self-custody digital assets. It also protects home and industrial mining, and bars an extra tax imposed solely because someone used crypto as a method of payment.

    That last clause is narrower than it sounds and more useful than it sounds. It does not exempt crypto from tax. It stops the state treating a crypto payment as a taxable event that the same purchase in dollars would not have been.

    Strategic Bitcoin Reserve Act

    Would have let the state hold bitcoin. It cleared the House and was then defeated in a Senate committee in April 2025 on a 6 to 5 vote.
