Bitcoin-Backed Loans in Tennessee

7 of the 7 Bitcoin-backed loan lenders we track serve Tennessee, with rates from 7.25% APR. Here is who lends in Tennessee, who doesn't, and what each offers.

Tennessee pairs zero state income tax with a crypto-friendly posture, so a resident who borrows against Bitcoin instead of selling avoids state tax on both sides and faces only federal capital gains if they ever sell. With no state crypto-lending regime, access comes down to which national lenders are licensed to operate in Tennessee.

Sell or borrow in Tennessee: the tax math

Selling Bitcoin in Tennessee triggers only federal capital gains tax, while borrowing against your BTC is not a taxable event at either level, so the state adds no tax cost to either path.

Tennessee levies no personal income tax. It never taxed wages, and its Hall income tax on interest and dividends was fully repealed effective January 1, 2021. As a result, the state imposes no tax on capital gains, including a gain from selling Bitcoin, so only federal capital gains tax applies to a BTC sale.

Important: not tax or legal advice

The tax and regulatory information on this page is general information, not tax, legal, or investment advice, and the rates shown are illustrative top-of-schedule figures, not a calculation of what you personally would owe. borrowonbitcoin.com is published by Sypher Capital; we are a publisher and affiliate referral source, not a lender, broker, registered investment advisor, tax preparer, or law firm. The state and federal figures here are compiled from public sources, including IRS Revenue Procedures, state departments of revenue and taxation, state statutes, and the Tax Foundation, and are current only as of the tax year shown; the sources are linked at the foot of this page. Tax and licensing law change, sometimes mid-year, and how any of it applies to you depends on your income, filing status, residency, cost basis, holding period, local taxes, and other facts this page does not capture, so your actual result can differ materially. The tax treatment of Bitcoin-backed loans is itself unsettled and still developing. Borrowing against Bitcoin carries its own risks, including forced liquidation of your collateral. Lender availability and a state's rules can both change; confirm current eligibility with the lender, and confirm your own tax situation with a CPA or qualified tax professional, before acting on anything here.

Why lender coverage looks the way it does in Tennessee

Tennessee has no crypto-specific lending regime and no BitLicense-style framework. The Department of Financial Institutions has stated it does not regulate virtual currency, and its money transmitter license and surety bond do not cover the transmission of virtual currency, though converting crypto to sovereign currency through a third party can fall under money transmission licensing. Availability of Bitcoin-backed loans is therefore broadly nationwide, subject to each lender's own multistate licensing rather than any Tennessee crypto statute.

Tennessee bitcoin law & policy tracker (2026)

Last reviewed · Reviewed quarterly

Tennessee was early to blockchain law and has stayed quiet since. For a bitcoin holder the state's most important feature is not on the docket at all: there is no state income tax, so there is no state capital gains tax either.

The tax position, which is the part that matters

Tennessee levies no personal income tax, and it finished phasing out the Hall tax on interest and dividends in 2021. A Tennessee resident who sells bitcoin owes federal capital gains tax and nothing to the state.

That materially weakens the usual tax argument for borrowing. In a state with a 5 percent income tax, not realizing the gain is worth 5 percent of the gain before you consider anything else. Here it is worth zero, and the case for a loan has to stand on the other reasons: keeping the upside, avoiding a sale you did not want to make, and the federal bill. Run both paths before assuming the loan wins.

The docket

  • Enacted 2018SB 1662 (2018)

Blockchain records and smart contracts given legal effect

Tennessee was one of the first states to put blockchain in its commercial code, giving distributed-ledger records and smart contracts legal effect and enforceability. It is infrastructure law rather than consumer law, and it does not touch lending, but it is the reason Tennessee reads as an early mover.

  • Introduced, not enactedHB 1695 / SB 2639 (2026)

    Tennessee Strategic Bitcoin Reserve Act

Companion bills that would let the state treasurer put up to 10 percent of designated state funds into bitcoin. Neither has been enacted.

As with every reserve bill in this tracker series, it is a question about the state's own balance sheet. It would not change what a Tennessee resident can borrow, or on what terms.

Lending and borrowing

Tennessee has no crypto-specific lending regime and no BitLicense-style framework. The Department of Financial Institutions has said it does not regulate virtual currency, and its money transmitter license and surety bond do not cover transmission of virtual currency, though a business converting crypto to dollars can still fall inside the regime.

Availability therefore comes down to each lender's own multistate licensing rather than to anything Tennessee requires. All seven lenders we track serve Tennessee.

Legislative status is current as of August 27, 2026 and re-checked quarterly. Bills move, take effect, and die between reviews, so confirm anything you plan to act on against the primary sources linked above and at the foot of this page. This is information, not legal or tax advice.

Lender availability above reflects each lender's stated state coverage, which we verify daily. This page is information, not legal or financial advice, and a lender's coverage or a state's rules can change, so confirm current eligibility with the lender when you apply.

Frequently asked

Does Tennessee tax the capital gain if I sell Bitcoin?

No. Tennessee has no personal income tax and does not tax capital gains, so selling Bitcoin creates only a federal capital gains liability. Borrowing against your Bitcoin is not a sale, so it is not a taxable event at the state or federal level.

Is there a Tennessee license or law specific to Bitcoin-backed loans?

No. Tennessee has no crypto-specific lending statute. The Department of Financial Institutions says it does not regulate virtual currency, and its money transmitter license does not cover crypto transmission, so lender availability depends on each provider's own multistate licensing rather than a Tennessee crypto rule.

Is Tennessee friendly toward Bitcoin?

Generally yes. Tennessee recognized smart contracts and blockchain records in law in 2018, and in the 2025 to 2026 session lawmakers introduced the Tennessee Strategic Bitcoin Reserve Act, which would allow up to 10 percent of certain state funds to be held in Bitcoin.
